Terms of Service

Effective date: May 30, 2026

1. Acceptance

These Terms of Service (“Terms”) govern your access to and use of the cutiepy.org website, the CutiePy desktop application, the FlatLine debugger, and any related services (collectively, the “Service”) provided by CutiePy (“CutiePy,” “we,” “us,” or “our”). By accessing the Service, creating an account, downloading the application, or sending us a text message, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you may only use the Service with the involvement of a parent or legal guardian. The Service is not directed to children under 13, and we do not knowingly collect personal information from children under 13. See our Privacy Policy for our COPPA-aligned data practices.

3. Accounts

If you create an account, you agree to provide accurate information and to keep your credentials confidential. You are responsible for all activity that occurs under your account. Notify us at legal@cutiepy.org if you suspect unauthorized use. We may suspend or terminate accounts that violate these Terms or that we reasonably believe pose a risk to the Service or other users.

4. The CutiePy Software

CutiePy is a Qt-for-Python desktop application shell. The FlatLine debugger is a companion runtime-diagnostic tool. We grant you a personal, non-exclusive, non-transferable, revocable license to install and run the desktop binaries for your own development and evaluation. You may not redistribute, sublicense, or sell the binaries except as expressly permitted in an accompanying open-source license file. Third-party components are governed by their own licenses (see THIRD_PARTY_LICENSES.md in the distribution).

5. AI Features — Third-Party Model Providers

CutiePy and the cutiepy.org site include features powered by third-party artificial-intelligence APIs, including OpenAI, Anthropic, Microsoft Azure OpenAI, Google (Gemini), and ElevenLabs. When you use an AI feature, the prompt, file, image, or audio you submit is transmitted to the relevant provider for processing. Those providers operate under their own terms and privacy policies, which you should review:

You are responsible for the content you submit to AI features. Do not submit unlawful, infringing, or confidential third-party material. AI output may be inaccurate; do not rely on it for medical, legal, financial, or safety-critical decisions without independent verification.

6. Acceptable Use

You agree not to use the Service to:

Violate any law, regulation, or third-party right.
Send unsolicited bulk email or SMS, or any communication prohibited by CAN-SPAM, the TCPA, or carrier rules.
Distribute malware, ransomware, phishing payloads, or other harmful code.
Engage in any of the SHAFT (Sex, Hate, Alcohol, Firearms, Tobacco), cannabis, illegal-substance, gambling, payday-loan, debt-relief, get-rich-quick, or fraud activities prohibited by The Campaign Registry (TCR) and U.S. carrier acceptable-use policies.
Attempt to gain unauthorized access to the Service, scrape it at a rate that degrades performance, or interfere with other users.
Reverse engineer the Service except where applicable law expressly permits it notwithstanding this restriction.

7. SMS / Text Messaging Program

If you provide your mobile phone number to CutiePy (for example, on a sign-up form, in your account settings, or as part of a support request), you may receive informational and account-related text messages from us, such as confirmation codes, support replies, transactional notices, and release announcements.

Consent. By submitting your mobile number through an opt-in form on cutiepy.org or in the CutiePy application, you expressly consent to receive SMS messages from CutiePy at that number, including messages sent via automated dialing systems. Consent is not a condition of purchase or of using any non-SMS feature.
Message frequency. Message frequency varies based on your activity. We typically send no more than a few messages per month per number.
Message and data rates. Message and data rates may apply, charged by your wireless carrier.
HELP. Text HELP to the originating short or long code at any time, or email support@cutiepy.org, to receive program information and support contact details.
STOP / opt-out. Text STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to the originating code to opt out. We will send one confirmation message and will not send further marketing or informational SMS to that number. You may also email support@cutiepy.org with “STOP” in the subject line.
Carriers. Carriers are not liable for delayed or undelivered messages.
No resale of opt-in data. CutiePy will not sell, rent, share, or otherwise transfer mobile opt-in data, mobile phone numbers, or SMS consent records to any third party for marketing or promotional purposes. Mobile opt-in information is also excluded from any other category of data sharing described in our Privacy Policy.

8. Email / CAN-SPAM

If you receive a marketing or product-update email from us, every message will identify the sender, include a valid physical postal address on request, and provide a working unsubscribe link. To opt out of all CutiePy marketing email, click the unsubscribe link in any message or email legal@cutiepy.org. Transactional email related to your account (security alerts, billing notices) is not subject to opt-out while your account is active.

9. Payments & Refunds

Paid features, if any, are billed through a third-party payment processor. By purchasing, you authorize the processor to charge your payment method. Recurring subscriptions automatically renew until cancelled. You may request a refund within 14 days of a charge by emailing legal@cutiepy.org; refunds are issued at our reasonable discretion and as required by applicable law.

10. User Content

You retain ownership of code, prompts, files, and other content you submit (“User Content”). You grant CutiePy a worldwide, non-exclusive, royalty-free license to host, process, and display User Content solely to operate the Service for you and to comply with law. You represent that you have the rights necessary to submit your User Content.

11. Intellectual Property

The CutiePy name, logo, mascot art, website design, documentation, and source code (except components released under an open-source license) are owned by CutiePy and protected by intellectual-property laws. Nothing in these Terms transfers ownership.

12. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE. CUTIEPY DOES NOT WARRANT THAT AI-GENERATED OUTPUT IS ACCURATE, COMPLETE, OR SUITABLE FOR ANY PARTICULAR USE.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CUTIEPY AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THE SERVICE. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) US$100.

14. Indemnification

You will defend, indemnify, and hold CutiePy harmless from any claim, damage, or expense (including reasonable attorneys’ fees) arising out of your User Content, your use of the Service, or your violation of these Terms or any law.

15. Termination

You may stop using the Service at any time. We may suspend or terminate your access immediately if you violate these Terms or if continued use poses a risk to CutiePy or other users. Sections that by their nature should survive termination (including 10–14 and 17) will survive.

16. Changes to These Terms

We may update these Terms from time to time. If we make a material change, we will post the updated Terms on this page and update the “Effective date” above. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

17. Governing Law & Disputes

These Terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict-of-laws rules. Any dispute will be brought exclusively in the state or federal courts located in Allegheny County, Pennsylvania, and you and CutiePy consent to personal jurisdiction in those courts. If you are a consumer residing in a jurisdiction that grants you the right to bring proceedings in your local courts, this section does not deprive you of that right.
